House of Lords Case

We were instructed by Miss D who was pregnant with a Baby conceived by IVF treatment using anonymous donor sperm.

When Miss D started the IVF treatment she was in a relationship with Mr. B.

Due to the fact that Mr. B had received treatment for testicular cancer, it was necessary for them to use donor sperm to conceive a baby; the donor of the sperm was and will remain totally anonymous.

The relationship between the parties ended but neither informed the Hospital and Miss D attended for a further IVF treatment.

That treatment proved to be successful and a healthy baby was conceived.

During Miss D''s pregnancy, Mr. B contacted the Mother as he believed that he should be declared to be the Baby's Father; Miss D disagreed with this view.

When the Baby was born, Court proceedings started almost immediately as Mr. B sought to become involved in the Baby's life.

Ultimately the case was ruled upon by the House of Lords and a final decision was made in favour of our Client, that Mr. B should not be the legal Father of the Child.

This case was unique as it dealt with a situation which had never been considered by the Courts before. It is now a formally legally reported case and has legal binding on cases of a similar nature.

This was a challenging case within which we assisted the Client with the media interest which surrounded the matter and at the same time ensuring that the identity of all parties was not revealed.

We secured the services of one of the top Barristers, Mr. Andrew McFarlane QC throughout this case. Shortly following the conclusion of the case Mr. McFarlane was appointed as a High Court Judge.
